Website Terms of Use

These Terms govern access to ForgeNine’s public website and protected proposal experiences. A separately signed consulting or project agreement controls the services provided to a client.

Agreement and business authority

By accessing or using this website, you agree to these Terms. If you use the website for an organization, you represent that you are authorized to act for that organization. Do not use the website if you do not agree.

ForgeNine is an independent business operated by Rob Taroncher. The website is intended for professional and enterprise audiences and is not directed to children.

Informational content—not professional advice

The public website describes ForgeNine’s capabilities, methods, examples, and potential engagement approaches. It does not create an adviser, fiduciary, employment, partnership, joint-venture, or client relationship. Content is not legal, tax, accounting, investment, cybersecurity, or other regulated professional advice.

Website descriptions are not an offer, guarantee, service-level commitment, or promise of a particular result. Enterprise AI performance, security, availability, and deployment fit depend on the client’s data, controls, environment, stakeholders, providers, and operating practices.

Business inquiries

Submitting an inquiry asks ForgeNine to evaluate whether a conversation may be appropriate. It does not require ForgeNine to respond, accept work, provide a free deliverable, keep unsolicited information confidential, or enter an engagement. Do not submit confidential information, credentials, production data, regulated data, or third-party information you are not authorized to share.

Proposals, signatures, and client agreements

Protected proposals are available only to authorized participants. A proposal is binding only if its own terms make it binding, the final version identifies the parties and governing law, a designated authorized signer executes that version, and any stated conditions are satisfied. Review access does not grant signature authority.

If these Terms conflict with a signed client agreement, the signed client agreement controls for that engagement. Electronic records and signatures may be used where the parties and applicable law permit them.

Acceptable use

You may not:

  • bypass authentication, rate limits, or other security controls;
  • access or attempt to access another person’s proposal, records, or account;
  • probe, scan, disrupt, overload, scrape, reverse engineer, or introduce malicious code except through a written ForgeNine-authorized security test;
  • submit unlawful, deceptive, infringing, harmful, or unauthorized content;
  • misrepresent identity, authority, affiliation, outcomes, endorsements, or ForgeNine materials; or
  • use the website in a way that violates law or another person’s rights.

ForgeNine may restrict access to protect users, clients, providers, or the integrity of the website.

Intellectual property

The website, branding, writing, diagrams, code demonstrations, and other ForgeNine materials are owned by ForgeNine or used with permission and are protected by applicable intellectual-property laws. ForgeNine grants you a limited, revocable, non-exclusive right to view the website for legitimate internal business evaluation. No other license is granted.

Third-party names and marks belong to their owners. References to a platform or provider do not imply endorsement, partnership, certification, or guaranteed availability.

Product and capability status

Sparks is identified as Alpha. Alpha functionality may change, be incomplete, or be unavailable in a particular environment. Current capabilities, environment-dependent deployment statements, and future vision are intentionally separated on the website. Images labeled conceptual are not product, client, or deployment evidence.

Third-party services and links

Hosting, security, email, signature, accounting, payment, and linked services are operated by their respective providers and may be governed by separate terms and privacy notices. ForgeNine does not control third-party availability or content. A link does not constitute an endorsement.

Privacy

The Privacy Notice explains how ForgeNine handles information. You are responsible for ensuring that information you provide is lawful, accurate, and appropriately authorized.

Disclaimers

To the maximum extent permitted by law, the public website is provided “as is” and “as available.” ForgeNine disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes a warranty or right that applicable law does not allow to be excluded.

Limits of liability

To the maximum extent permitted by law, ForgeNine will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity arising from use of the public website. These limitations do not apply where prohibited by law or to liability that cannot lawfully be limited.

Liability for consulting work, deliverables, confidentiality, intellectual property, security obligations, payment, and termination is governed by the applicable signed client agreement—not these public Website Terms.

Changes and availability

ForgeNine may update the website or these Terms. The effective date above identifies the current version. Material changes will be presented through a reasonably prominent notice when required. ForgeNine may suspend or discontinue website features without creating an obligation to continue them.

General terms

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. These Terms and the Privacy Notice are the entire agreement governing use of the public website; a signed client agreement separately governs client services and specifies its own governing law and dispute terms.
